How long does GIDC transfer take? +
An informal (third-party) GIDC transfer typically takes 45–90 days when documentation is complete. Formal transfers (family/death/partnership changes) can be faster. We track the progress daily and flag any issues immediately.
What is 2(r) mortgage permission and why is it needed? +
Under Section 2(r) of the GIDC Act, an allottee cannot mortgage a GIDC property without GIDC's written permission. Banks require this permission before sanctioning loans against industrial plots. We prepare and file the complete application.
What happens if I don't get PTO before operating? +
Running a GIDC unit without Permission to Operate (PTO) is a violation of GIDC's allotment conditions. GIDC can issue show-cause notices and, in repeated cases, cancel the allotment. Apply before commencing production.
Can a cancelled GIDC allotment be revived? +
Yes — under GIDC's Revival Policy, a cancelled allotment can be restored by paying the applicable revival fees and penalty, along with a fresh construction commitment. Time is critical: delays reduce revival success chances.
Is GST applicable on GIDC plot transfer? +
The Gujarat High Court (Dec 2025) ruled that assignment of GIDC leasehold rights by a lessee to a third party constitutes a transfer of immovable property — NOT a supply of service — and is therefore not liable to GST. We guide you on GST implications specific to your transaction.
Can I sublet my GIDC property? +
Yes, with prior permission from GIDC. Subletting is allowed for industrial, commercial, housing, petrol pump, and mobile tower plots. We prepare the sublet application, draft the agreement, and ensure full compliance with sublet fee payment norms.
